Eligible Dependant - Don't Make This Mistake

ImageIf you are married or living common law you can not take a deduction for eligible dependant! Yes even though your child is a dependant this does not allow you to claim this deduction.

If you are single, separated or divorced and have a dependant who lives with you and who is under 18 years old, you can claim this deduction. The deduction is reduced by the dependants income.

If you paying child support for the dependant at any time in the year you can not take a deduction for eligible dependant.

Only one person in a household can take a deduction for eligible dependant. For example if you share a household with someone who has children as well as yourself, you cannot both take a deduction for eligible dependant. Even if you are sharing a household with a freind and are obviously not a couple.  The rule is only one eligible dependant per household.

You cannot share the deduction for eligible dependant with someone. For example you can not take half the deduction for the part of the year the dependant lived with you. If the dependant is living with you part of the year as part of a shared custody agreement and part of the year with the other parent and neither parent pays child support to the other you can choose by written agreement between you to have one (only one) or the other take the deduction for eligible dependant.

My son turned 19 at the end of 
Mar 06 and still attended high 
school and was totally financially dependant. How can I 
claim him. Not every person completes high school at 17/18!!

My 16yr old brother has lived with me and my fiance for the past year and a half. His dad (mercedes benz salesman) has given me personal checks of $300 a month for child support and pays for medical insurance. In CA $300 isn't much. I pay all the food, utilities, and recreation. Even though I disagreed the father wants to cliam him. Can you advise me?

For Brother's Keeper - his son does not live with him. That makes the father ineligible to claim. 
 
For the 19 year old, he is no longer considered a minor. He was eleigible to work and pay taxes as a adult, and thus you cannot claim him, except possible for education expenses. Those laws apply until a dependent is 24 or graduated from college/university. However, I am not sure if they now apply to grade school.

IN 2009 we had our first child. My wife took an early leave of absence starting January 2009. She did not go back to work. Would she classify as a dependent ?

So here's my situation: Got married overseas in April 2010, My Wife is still awaiting her immigration process to complete and hasn't joined me in Canada and wil not be joining me in 2010. 
 
In the past I had been claiming my mother who resides with me as an eligible dependent on my Taxes. What to do in this situation where I'm not necessarily supporting my wife yet I'm married? 
 
Can I still claim my mother as an eligible dependent since she had been living with me in 2010 versus my wife?

I was married in 2010 Oct.1st,can i claim my daught. as an eligible dependent for9 months. Just because the form does say at any time during the year if you were single,divorced etc.

I am separated from my husband. We have two children under 18 yrs. We have joint custody whereby I have them one week, then he has them the next week, etc. Can we both claim one child as an eligible dependant? We live in separate households, and we both financially support the children. No support payments as we have the children an equal amount of the time.

My husband and I (living together & married) have a son who turned 18 in May of 2010. He is still in high school and has no income. Are we(one or the other) able to claim him as a dependent for our 2010 tax return? :?

My husband lived with me all of 2011, he is a foreign national with no status in Canada, but did not earn any money for the whole year. Can I claim him as a dependant?
